I think the only time that strategy (saying the item is sold as-is) would be a device that is advertised as non-operational. E.g., I sold a couple of minidisc recorders that were kaputt, and I very clearly advertised them as such. Because they were sold as-is, someone couldn't come back and say "they don't work!" But, I guess it's that the item has to fit the description.
