again, whoever made the software, had no right to include the data that they had on it in the first place. your excuse of selling something you purchased....the infringement is already there, so you become a part of it.

your two examples...they were official releases...yours is not.

Yes they did, they had a license from WOTC to make the product.  Where is the infringement.   They legally were able to produce the sets.

Here's the press release where they lost the right to continue to sell new copies of the datasets.  

While these sets were manuafactured I purchased them legally.   I am not selling a new copy of the program I am selling my copy.  

From the CMP website:

Without preamble or holding anything back it's pretty simple:

Effective November 30th, we will no longer hold license with Wizards of the Coast to produce data sets of any kind for any program.

Wizards of the Coast has declined to extend our agreement, initially citing no reason. Then, after speaking with our contact at-length, we got this explanation: "Because of Future Product Considerations."

Whether this means 4th Edition is looming, they're doing things in house, or they've decided to give a license to someone else, we simply don't know.

What this means in simple terms is that as of December 1st there will be no Wizards of the Coast products available for sale from us. No data sets for e-Tools, PCGen or RPG Foundry. No Interactive Adventures or Atlases. No Fantasy Grounds Data Sets. Nothing. (And, yes, that does mean that all RPG Foundry data set pre-orders will be canceled and refunded.)

That does not mean that we're going out of business. We're not! This has no impact on our other publishers. We will still be producing data sets for them, and in fact we're working on adding a few other publishers to the list of those we do business with in order to bring even more data sets to you guys and gals.

This does, however, also mean no more e-Tools program sales. Which is not as big an issue as e-Tools was at the end of its life cycle, anyway. We had three new data sets for release this month, but that's not happening now as Wizards won't approve them at this stage. And we were basically done with e-Tools, anyhow.

So for a couple months we'll be producing and selling data sets for PCGen, only, until RPG Foundry is out.

But not all is "doom and gloom" around the Zoo! So here's the silver lining on those black clouds. We have (so far!):

Bastion Press and Zeitgeist Games have agreed to allow for our original RPG Foundry Data Swap. So for those products there will be a free data exchange option for RPG Foundry-format data sets from original e-Tools and/or PCGen purchases.


We're working on adding several other publishers to our list for PCGen and RPG Foundry data set creation, and not just for the D20 system! And things are looking good there. We can't say who at this time since negotiations are ongoing, of course, but we think people will be pleased.


In the next cycle of releases/updates (later this month) we'll finally be revising our PCGen data sets to support PCGen Stable Production Release 5.10.1! Testing was finally concluded without any major changes (primarily to game modes settings since PCGen code changed a few things there - more details/comments at release time on this) and all is looking good.


We'll be continuing to sell Bastion Press product PDFs and we're working with a few of our other publisher partners to sell their PDFs as well.


And we've got a few other things "in the works" that we can't detail just yet... but when we can say more we will!

As a final note on data sets: The "2 years of support" will officially begin as of December 1, 2006, and end December 1, 2008. We'll still be doing updates, bug fixes, etc on both the e-Tools and PCGen data sets. That hasn't changed. You'll still be able to download the files that you've previously purchased (all data, the e-Tools Program itself, the Interactive Adventures and the Fantasy Grounds data sets) until that date.

I'm sure some of you are wondering by now if this is going to impact RPG Foundry in any way, so let's address that. Only slightly. Some of you may remember that we said we were basing our initial data sets for RPG Foundry by importing our PCGen files, since they were text and easier to manipulate. But it's still a monkey-ugly conversion with lots of work needing to be done to massage that data into RPG Foundry format, so we've been saying we weren't going to do any type of converter to release to folks because of those reasons. Well... we're revisiting that option given the new circumstances. We're looking at making a slightly higher-functioning converter (though it still won't ever be perfect) available that will at least get the data massaged in such a manner that it's usable in RPG Foundry from PCGen and e-Tools. When we do, we'll release it as a standalone, "alpha test," unsupported application for folks.

There isn't really much more to tell. Those are the highlights of things, as we can tell them to you.

No punches pulled, no lies, just the plain, painful truth. As much as we can tell, anyway, because of NDAs.

We're not going anywhere, we're not folding shop and running away, RPG Foundry isn't dead and neither are we.

So you're stuck with us Monkeys for a long time to come yet.

I honestly thought that most of the members here would have heard of this software in the past. It was fairly popular back in the early 2000's. Code Monkey did have a license from WoTC to do this software. I don't know how good it was as I never bought it, but it was 100% legit software. One of the rumors running around when WoTC did not renew their (code monkey publishing) license was that WoTC was not happy with seeing how well cmp was doing with their IP and they wanted to try it themselves. Just my 2 cents but there's still a lot of information out there if someone wants to "google" it.


Now as to whether he has ability to resale their software....now thats a whole other ball game, and without viewing the EULA's(End User Licensing Agreement) that came with it, none of us are in a position to answer that truthfully. If one can still access the EULA that pertains to this specific piece of software from their website, we might be able to get more information, but thats different than saying "its not legitimate software" and can go back to the whole software question in general. Has someone compared the EULA that came with this to the EULA that comes with Core Rules CD-ROM? Can people legally resale the Core Rules CD-ROM? Without viewing that EULA, I can't tell you either.

I think Code Monkey's is exactly where you should look to determine this.  There is no problem with reselling most commercial software.  But most items such as the offical D&D pdfs, mp3s from various sources etc are all nontransferable.

When you start looking at the CMP website you see things such as:

Wizards of the Coast says, you can create your own datasets for personal use but it is illegal for you to share this with others (even not for profit).  Their end user agreement is the same as the pdfs nontransferable.

Is this legal to do?  Of course it is.  When you bought the datasets, you agreed that they were still property of WotC and other publishers and for you personal use not for resale or duplication.  Lots of other companies do the same thing.  It is also illegal to sell your World of Warcraft character as well.

Whether you have the legal right to sell your copy of the software is irrelevant.

You were offering for sale a back-up copy of the software and that is against the law no matter how you spin it.

Your Right I did use the term Backup Copy in the description for the Etools program itself.   That was clearly my fault.  I have since located the original CD I had assumed I would be able to find it and got lazy in updated the description.  


Hear is the agreement and it does allow for Transfer of Sale as long as the purchaser agrees to the terms.

This patch for the E-Tools program, which will fix a lengthy list of bugs, will be completed and made available within 90 days to Wizards of the Coast. I am selling of all my purchased datasets for PCGEN and Etools that I obtained from Code Monkey publishing.   These datasets were legally produced by them for WOTC under license.  (see above press release).  I have all the original receipts for these datasets and will provide them as proof of transfer of the license.

These datasets cost approximately $450.00 when purchased.   They can no longer be sold by code monkey because WOTC revoked the license in 2007.    Code Monkey is providing support for this software through December 31, 2008.   It is unlikely that they will patch the datasets for E-Tools however.

I am also including an original CD of the Etools program itself along with the patch to bring it to the latest version of the program.   The latest version is 1.666.

I will provide the link to download PCGEN.   PCGEN is an open source program that can be downloaded for free in a matter of minutes.   It is Java Based software.    The current version of PCGen is Version 5.13 the datasets will only work on Version 5.12 which is still downloadable.   Code Monkey might or might not update the datasets to version 5.13.

Again, these sets are 100% legal and I have the right to sell my originals under the terms of the software license agreement.

Going by the title, it seems this software generates characters. What else does it do? There are modules included in the list, not just rulebooks, so my guess is that you can just print out whatever you might like from the "datasets", which is probably a fancy term for searchable PDF's.


If you hit a Rowsdower, you get to keep it.

No you cannot just print out the rulebooks.    The modules include the magic items and the NPC's stats not the modules themselves or any desctipions of the text.    You also still need the PHB / DMG and whatever books to get the full descriptions of the spells etc.

The program included a Character Generator the purpose of the additional books was to allow for the creation of the character utilizing the new spells, equipment, classes etc.   The program would then automatically add the necessary feets, skills points etc,.

You would create a character similar to the core rules / core rules expansion however, unlike those programs which contained the full text these do not.   In addition, you cannot directly access the data in a usable format it's built into the program itself.

It also included the ability to quick generate NPC's, Customize Monsters, there is a dice roller, random encounter and radom treasure generators as well I believe.

With the Generate Table feature any table in the mentioned books was presented and it would randomly roll on the table for you and display the results:

For Example:  From the DMG the Random Adventuring Table would roll a 1d100 and display the result:
Two parts of a magic item are in the hands of bitter enemies, the third is lost.
