Reply from her:

Dear oldschooldnd,

RPGnow.com is the only place I know where you can purchase TSR products. And this is where I purchased it in 2005.

Never mind, she's a hammerhead:

No. This has been re-encrypted for my own personal use, and is from my collection. It has no watermarks or security. Should be able to reassemble, modify, copy ect.

Reported her.  Does she really think it's legal?

Apparently she does:

You are incorrect about TSR line of copyright matrial. When Wizards of the Coast purchased TSR, the copyright patents were never renewed and all TSR products copyright patents expired.

Yahoo! - 404 Not Found
TSR, Inc. - Wikipedia, the free encyclopedia.

With the copyright patents legaly expired, there is nothing ilegal about selling, purchasing, copying or distributing TSR products

What a moron.

I just went to RPGNow as I wanted to see what rights were given when purchasing a PDF.

I like the ability to de-activate a device for the DRM copies:

Can I deactivate a device?

Yes, though you must call Adobe Customer Service to do so. They can be reached at: XXX-XXX-XXXX.

The hard part is getting through to Adobe customer service at XXX-XXX-XXXX            8O  8O  8O  8O  8O  8O  8O  8O

It made no mention of selling your license.  I suspect there is a clause in there about not reselling it but couldn't find it.

I am no lawyer, but I think she is mistaken about the difference between not using a trademark...such as TSR...and giving up a copyright.

A copyright exists for a given number of years and can be renewed.  I believe the copyright exists for something like 70+ years.

I think she has read the line, "TSR trademarks were allowed to expire" and confused it with, "WOTC was so stupid that they allowed millions upon millions of dollars intellectual properties to go public domain."

I believe she has confused the legal concept of "failing to defend a trademark" with copyright law.

I believe there is a 99.5% chance she is totally wrong.

Ah!

I went back to report her again and I see that the listing has been removed as an "invalid item."

People can pretty much convince themselves of anything they want to believe.

That one is not necessarily illegal. If everything is 100% Open content and the seller is simply charging for the physical medium (ie, the cost of making the DVD) and shipping, I think its perfectly legitimate. ;)

Surly has the proper attitude.
I get a kick out of the "no violation" statement, but no list of the material.

Hi, with reguard the role playing guides i was selling im affraid ebay has taken it on them selfs to remove this listing. It did not contain any copyright material and was probally reported, by someone selling similar stuff as i was selling it cheapper, which is a shame. i shall have to relist when i can get more proof of what im selling is not copyright and contact you if you are still intrested when it is relisted, thanks grinners30

well basically all he had to do was list the stuff that was on the CD - simple as - that would be more than justified proof, yes?

by the mere fact that he hasnt, implies that he is guilty because he doesnt want to reveal the details!
