Just send a message to the seller that what he is doing is illegal and against the law.  Then send a message to Ebay stating the same thing.  You can probably get him for keyword spamming as well:

Reported him for both keywording and bootlegging....two reports.

What really pisses me off is this guy's coy wording about how, "I'm not sure if you should already own a copy.  If you bid I'll assume you do."

Reported him twice just for that.

Is there any acceptable amount of copying with an old module or magazine? I have boxes of incomplete modules, mostly missing pull out sheets or handouts. Can these missing pieces be copied and included with a module and sold? If so, how many pages? Would copies of covers be allowable?

As long as you sell it through eBay you are allowed to have 99.99% of the material photocopied.
