I reported it, and not for the first time.  eBay doesn't seem to care about PDFs.

I'm not sure if that is the case or if it is more because this auction is being sold as a digital item.  Digital items are not covered by paypal or ebay protection so they seemingly have no liability if anything goes wrong with the transaction.

By digital item I mean one that will not physically go in the mail.  All the seller does is either email it to the buyer or sends the buyer a link where they can download it.

Which brings up the question, is it illegal to sell a list of links on where to download the items.  All you are doing is selling the results of your google skills.  Whether the buyer decides to download them is another matter.

Not sure, but I'd say yes.  Under ordinary circumstances, it is not illegal to link to another site.  

However, assisting someone in performing a crime is itself a crime.  Distributing these PDFs is illegal.  Assisting in their distribution by making their location widely known (ie. advertising) might qualify.

I'm sure if the linked files were child porn, instead of something mundane like PDF files, the authorities would be very interested in speaking to the linker, not just the linkee.  :wink:

Sometimes I wonder where eBay's brains are.

There are times when pdf auctions are posted and they get taken down in due process (after being reported). Other times they just stay up.

I reported all of them twice.  One each under:

Listing Violations > Counterfeits and copyright violations > Other potential infringement > Offering to electronically send or receive copyrighted material

and once each under:

Listing Violations > Counterfeits and copyright violations > Bootlegs and counterfeit media > Media on Recordable formats (CD-R, DVD-R, VHS Tape, etc.)

Re-reading this was so much fun.  I love the intro to this post in particular:  Wrong BCLARKIE.  Almost like the poster was waiting for the perfect moment to pounce.  Some of this crap is too funny....I could probably stick the above post in the script of any daytime soap opera and it would fit perfectly with the rest of the overly-emotional drivel that you normally hear on Days of our Lives or Young and the Restless.
