Now I am getting confused (not unusual with American laws, etc.!).

Is the law saying that, if I buy two copies of, say, a mint-condition Q1 Queen of the Demonweb Pits, then turn around and sell one on EBay, that is illegal??  Or would it be true if, instead of Q1, it was two copes of the legendary ST1 Up the Garden Path---or the R1-R4 series, or the original white copies of the original (early 1970's) books?

For that matter, would it be illegal to split up one of the 25th-Anniversary Collector's edition boxes into multiple individual sales (as has been done in several eBay auctions)?

There is nothing illegal about splitting up or selling original material - the stuff that TSR actually sold.  The illegal part is that some people are making photocopies or electronic copies and selling this material which is illegal.

In the case of something rare like ST1 which holds a high monetary value, I think there is a more severe criminal offence that could be applied.

not only that, its a book by monte cook, who's wife is here normally posting ebay listings in the classifieds. methinks a msg to them about it would be a good move?

i have sent the seller a msg just warning him of copyright infringment and also that monte cook is quite active on ebay too (well i know HE isnt, but its almost the same, with it being his wife Sue.)

might be worth others bombarding him and reporting him too.

I reported it, and not for the first time.  eBay doesn't seem to care about PDFs.

I'm not sure if that is the case or if it is more because this auction is being sold as a digital item.  Digital items are not covered by paypal or ebay protection so they seemingly have no liability if anything goes wrong with the transaction.

By digital item I mean one that will not physically go in the mail.  All the seller does is either email it to the buyer or sends the buyer a link where they can download it.

Which brings up the question, is it illegal to sell a list of links on where to download the items.  All you are doing is selling the results of your google skills.  Whether the buyer decides to download them is another matter.

Not sure, but I'd say yes.  Under ordinary circumstances, it is not illegal to link to another site.  

However, assisting someone in performing a crime is itself a crime.  Distributing these PDFs is illegal.  Assisting in their distribution by making their location widely known (ie. advertising) might qualify.

I'm sure if the linked files were child porn, instead of something mundane like PDF files, the authorities would be very interested in speaking to the linker, not just the linkee.  :wink:
