1. Inform seller that the product is illegal and therefore payment would constitute infringement.

2. Proceed to leave 9,999 negatives.

3. Laugh like a rabid hyena on crack.

That is hysterical!

The tragedy is - the seller's tone in the email suggests that he feels a faint hope that he is actually going to receive 50 grand!
(I bet you'd get a phone call from paypal if that kind of folding was put into your account!)

Well, surprisingly enough, the seller didn't realize it was illegal. When eBay informed him why they nulled the auction, he sent me an apology. I tried to get him to sell them outside of eBay and he refused because, amazingly enough, he didn't want to commit infringement. I almost felt bad!

That's funny.   I hope he has to pay Seller's fees on that.

That'd be insult on top of the injury...

The negative feedback won't ever appear. The seller can reverse the transaction if he wants, and the buyer is not allowed to leave feedback for 5 days, or until the seller has marked the item sent in his account.

On the up side, the seller will pay fees temporarily until eBay sort it all out and refund them to his account. If he's close to his billing date, he'll be hit hard. If he's just paid last months fees, they'll have it sorted by next month.

For those of you who remember, that's what knocked Jonb of eBay for 2 weeks at the beginning of his last spree. etc_stole_my_money bought most of his BIN stock. He managed to list his stuff again within hours because he reversed the transactions with the 'Buyer and seller mutually agree not to proceed' option, but he couldn't pay his fees.

This week I've been mostly eating . . . The white ones with the little red flecks in them.

Final Value Fees
Closing Price         Final Value Fee

$0.01 -- $25.00      5.25% of the closing value

So, it's $2619.48, if calculated on 9999 $4.99 items...

Ouchie.

A mechanism exists to defeat this, but is seldom used by sellers. You can designatie how many items one buyer can purchase from you in a certain period of time (I believe it is ten days, I'm too lazy to look).  However, most sellers are either not informed of this or are too greedy to set it up ("I don't want to limit my buyer in how many illegal items he wants to buy!").

What really irritates me about these guys is that they think the rest of us are suckers.  We're schmucks for playing by the rules and not breaking the law.  They think of themselves as clever.  Since they seem to get away with it...maybe they are.
